中国篮球协会颁布有关运动员教练员合同的规定 将对签署阴阳合同的俱乐部予以处罚
PROVISIONS ON CONTRACT OF ATHLETES AND COACHES PROMULGATED BY CHINABASKETBALL ASSOCIATION
IMPOSE PENALTY ON VIOLATING CLUB WITH WHITE-BLACK CONTRACT

中国篮协发布了《关于办理外籍及港澳台运动员、教练员注册工作的程序及要求公示的通知》篮球字〔2014〕443号，通知中对阴阳合同等违规行为做了明确处罚规定。如经查实，中国篮协将视情对违规俱乐部进行罚款(10万-500万元人民币)或取消注册资格等处罚，其中有关运动员合同的规定如下：
China Basketball Association promulgate NOTICE OF PROCEDURE AND PUBLICITY REQUIREMENT RESPECTING TO REGISTRATION OF ATHLETE AND COACH WITH FOREIGN NATIONALITY AND FROM HONG KANG, MACAO, TAIWAN with Ref. No. 〔2014〕443, in which the penalty provision on violations including white-black contract is stipulated definitely. The violated club will, where verified by China Basketball Association, be punished with penalty fine of from one hundred thousand to five million Yuan RMB or cancellation of registration, among provisions the stipulations respecting to athlete / coach are as follows:
(五) 对于俱乐部与运动员、教练员及其具有国际篮联经纪资格的经纪人签订的聘用合同，具体要求为：
Particular requirements on employment contracts between club and athlete / coach in addition to agent with the capacity of FIBA brokers are as follows:
1. 必须提供中英文对照合同原件，一式三份。
Original copies of contract with Chinese / English, in triplicate, should be submitted.
2. 运动员、教练员必须在合同的每一页上签字并标明日期。
The signature of athlete / coach, with date on each page of contract should be required.
3. 俱乐部在合同原件上加盖骑缝章，同时要有俱乐部法人代表的签字和俱乐部公章，合同包含的基本要点详见《中国篮球协会俱乐部、运动队、运动员和教练员注册管理暂行办法》(2014年)第18页第七十一条第四款。
Original contract should be stamped, by club, with paying seal in addition to the signature of club’s representative and official seal. The basic issues including contract are detailed in Subsection 71. 4 in page 18 of CBA’S INTERIM MEASURES OF REGISTRATION MANAGEMENT OF CLUB, TEAM , ATHLETE AND COACH (2014).
(六) 运动员、教练员与具有国际篮联经纪资格的经纪人签订的经纪合同原件。
Original brokerage contract which is concluded between athlete, coach and broker or agency with the broker’s qualification of The International Basketball Federation.
(七) 俱乐部如注册亚洲籍运动员，除提供上述材料外，还需提供以下材料：
Where club will register the athlete with Asian nationalities the following materials should be submitted in addition to the same above.
1. 出生地为亚洲的证明。Certification of born place in Asia.
2. 亚洲籍运动员本人书面承诺书并加盖俱乐部公章，承诺无双重国籍，如隐瞒事实，一切责任由该运动员和所在俱乐部承担并由此受到中国篮协相应的处罚。
The written commitment, with club’s official seal, by the athlete with Asian nationality itself represent and promise no dual nationality, in case of hiding the fact, any and all liability should be undertaken by the athlete and the club by which the athlete employed, including corresponding punishment by CBA.
3. 代表所在国家或地区参加国际篮联和亚洲篮联组织的正式比赛的相关证明材料。
Relative certificate documents of joining, by and on behalf of its the country or region，official games which are organized by International Basketball Association and Asian Basketball Association.
4. 国际篮联或亚洲篮联出具的相关证明材料。
Relative certificate documents issued by International Basketball Association and Asian Basketball Association.
四、索要澄清信的程序、规定及相关合同要求

7. 注册审核通过后，俱乐部、运动队与运动员签署的合同方可生效。
The contract which is concluded between club, team and athlete will, only upon acceptance through examination / review, become effective.
8. 俱乐部、运动队必须保证所提供的相关注册材料的准确性和真实性，并承担因误报、虚报、瞒报而产生的一切责任。针对俱乐部的严重违规行为，特别是阴阳合同，一旦通过诸如国际篮联仲裁(BAT)曝光合同争议或举报等途径查实，中国篮协将视情对违规俱乐部进行罚款(10万-500万元人民币)或取消注册资格等处罚，并给予举报人适当现金奖励。
Club and team should ensure the accuracy and authenticity of relative registration materials submitted and undertake all liabilities which are arising out of erroneous report, false report and concealed report. Aiming at the serious violations of club especially white-black contract, in case of verification of violations through reported contract dispute by BAT or accusation, Chinese Basketball Association will impose fines of 100,000Yuan to 5 million Yuan RMB on illegal club or make cancellation of its registration in addition to award reporter certain cash reward.
本规定自2014年9月1日起执行，解释权归中国篮球协会。
This regulation will come into execution as of 1st September 2014 and interpretation hereof shall remain vested solely in China Basketball Association.
